Due to the informal nature of a lot (too many if you ask me) construction projects, there is often a question of whether or not there was a legally binding contract between the parties.
A recent trial decision released by AJ Robinson discusses this very question.
AJ Robinson goes through the test and looks at whether parties agreed on a price for the supply of materials and services, the required scope of work, and the agreed upon completion date to conclude that an owner and contractor did in fact enter into a legally binding contract.
Good decision on some construction law fundamentals. Click here for a link to the decision.
